Terms of Service

Welcome to Bumped. These Terms of Service ("Terms") are a legal agreement between you and Sunshine Wrap LLC, doing business as Bumped ("Bumped," "we," "us," or "our"), a company organized in the State of Florida, United States. They govern your use of the Bumped website at bumpedapp.com and any related services (the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Important: Section 17 contains an agreement to resolve disputes through binding individual arbitration and a waiver of class actions and jury trials. You can opt out within 30 days as described there.

1. Who can use Bumped

• You must be at least 18 years old. The Service is for adults only. If you are under 18, you may not create an account or use the Service.
• You must be legally able to enter into a binding contract and not be barred from using the Service under any applicable law.
• You may keep only one account, and you may not create an account if we previously suspended or banned you.
• Age verification. Before your first random chat, you must complete an age check through our provider (currently Didit): a short selfie video, and a photo ID if your age can't be confirmed from the selfie. If a check shows you are under 18, we will suspend your account. We may ask you to verify your age or identity again at any time. If you do not complete verification, we may limit or close your account.

2. Your account

You agree to give accurate information (including your date of birth), keep your password secure, and not share your account. You are responsible for everything that happens under your account. Tell us right away at support@bumpedapp.com if you believe your account has been compromised.

3. How the Service works

Bumped randomly connects adults for live video and text chats. During a video chat, either person can send the other a virtual gift. If both people choose "Add friend," they can later message, call, and send each other gifts. We do not choose, screen, or vouch for the people you meet. You interact with other users at your own risk. Use good judgment, do not share personal or financial information with people you don't know, and be careful about meeting anyone in person. Any in-person meeting is entirely your decision and your responsibility.

We do not record or store the video or audio of your calls. Video and audio travel directly between devices, or through an encrypted relay when a direct connection is not possible.

4. Community rules

You agree not to use the Service to, and not to help anyone else to:

• show, share, or request nudity or sexual content, or engage in any sexual activity on camera or in chat;
• involve, depict, or interact with anyone under 18, or sexualize minors in any way. We have zero tolerance for child sexual exploitation. We remove such content and report it to the National Center for Missing & Exploited Children (NCMEC) and law enforcement as required by law.
• harass, bully, threaten, stalk, intimidate, or demean anyone, or post hate speech;
• scam, defraud, extort, or solicit money, gifts, or coins from others, or offer paid services of any kind;
• record, screenshot, stream, or share another user's video, audio, image, or messages without their clear consent;
• impersonate anyone or misrepresent your identity, age, or affiliation;
• promote violence, self-harm, illegal drugs, weapons, or any illegal activity;
• send spam or advertising, or use bots, scripts, scrapers, or automated means to access the Service;
• interfere with, hack, overload, or bypass any security or safety feature of the Service, including age, bot, or report systems;
• infringe anyone's intellectual property, privacy, or other rights; or
• violate any applicable law.

5. Reports, moderation, and enforcement

You can report or block any user at any time. We review reports and may, at our sole discretion and without prior notice, remove content, pause random chat, suspend, or permanently ban any account we believe violates these Terms or puts others at risk. We may also share information with law enforcement when we believe in good faith it is necessary. We are not obligated to monitor the Service, and we do not guarantee that we will catch or act on every violation.

6. Your content

You are solely responsible for what you say, show, and send on the Service ("Your Content"). You keep ownership of Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display Your Content only as needed to operate, protect, and improve the Service (for example, delivering your messages to your friends or reviewing a report). We are not responsible for content posted or shared by other users.

7. Coins and virtual gifts

• What coins are. Coins are a virtual item you can buy and use only to send virtual gifts to other users on Bumped. Coins are a limited, personal, non-transferable license to use a feature of the Service. They are not money, have no cash value, are not your property, and cannot be redeemed, exchanged, or refunded for money by the buyer, except where the law requires otherwise.
• Bonus coins. We may give you free bonus coins, for example when you join or when a friend you invited joins. Bonus coins can be sent as gifts like other coins, but they are promotional only: gifts paid with bonus coins do not create earnings for the person who receives them. When you send a gift, your bonus coins are used first. Bonus coins can't be bought, sold, or transferred, and we may change, limit, or end bonus programs, or remove bonus coins obtained through fake or duplicate accounts or other abuse.
• All purchases are final. Coins and gifts are delivered immediately and are non-refundable, except where required by law.
• Gifts are final. Once you send a gift, it cannot be undone or returned.
• Payments. Purchases are processed by our payment provider, Stripe. You authorize us and Stripe to charge your payment method for the price shown at checkout, plus any applicable taxes.
• Chargebacks and fraud. If a payment is reversed, disputed, or found to be fraudulent, we may remove the related coins (your balance may become negative), reverse related earnings, and suspend your account.
• Changes. We may change coin prices, gift options, and how coins work at any time. Unused coins are forfeited if your account is closed for violating these Terms, or if the Service is discontinued, except where the law requires otherwise.

8. Earnings and withdrawals

• When other users send you gifts, you may earn a cash amount at the rate shown in the app (currently 70% of the gift's coin value, where 100 coins equal $1.00). Only the part of a gift paid with purchased coins counts; the part paid with bonus coins does not create earnings. We may change this rate for future gifts with notice in the app.
• New earnings are held for a review period (currently 7 days) before they can be withdrawn. You may withdraw once your available earnings reach the minimum shown in the app (currently $10.00).
• Withdrawals are paid through Stripe. To withdraw, you must complete Stripe's identity, tax (for example, Form W-9 for U.S. persons), and bank verification and agree to Stripe's terms. We are not responsible for delays or errors caused by Stripe or your bank.
• Payout fees. Our payment provider charges a fee to send money to your bank. That fee is deducted from each withdrawal, and the exact amount, and what you will receive, is shown before you confirm. If your available balance is smaller than the payout fee, it cannot be withdrawn until it grows.
• Withdrawals are only available in countries and currencies supported by Stripe's payout service. If payouts are not available where you live, you may still send and receive gifts, but you may not be able to withdraw earnings.
• We may delay, withhold, reverse, or cancel earnings and withdrawals connected to fraud, chargebacks, suspicious activity, or any violation of these Terms, including soliciting gifts.
• Earnings are gifts from other users, not wages. Nothing in these Terms creates an employment, agency, or partnership relationship between you and us.
• Taxes are your responsibility. You are responsible for reporting and paying any taxes on your earnings, whether or not you receive a tax form. Where required by law, we or Stripe will issue tax forms (such as Form 1099) and report payments to tax authorities.

9. Our intellectual property

The Service, including its software, design, logo, name, and content we provide, belongs to us or our licensors and is protected by law. We give you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes under these Terms. You may not copy, modify, reverse engineer, resell, or create derivative works from the Service.

10. Copyright complaints

If you believe content on the Service infringes your copyright, email support@bumpedapp.com with: your contact information; a description of the copyrighted work; where the material appears on the Service; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that the information is accurate and you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove material and terminate repeat infringers.

11. Third-party services

The Service relies on third parties, including Stripe (payments and payouts), Cloudflare (network, security, bot protection, and video relay), Railway (hosting), Resend (email), and Didit (age verification). Their services are governed by their own terms, and we are not responsible for them.

12. Ending your use

You can stop using the Service at any time and ask us to delete your account by emailing support@bumpedapp.com (or using an in-app option, when available). If you delete your account, any unspent coins are forfeited. Please withdraw any available earnings before deleting your account. Earnings that are still on hold, below the withdrawal minimum, or that cannot be paid because you have not set up payouts will be handled as described in the app at the time of deletion and as required by applicable law, including unclaimed-property laws. We may suspend or terminate your access at any time, for any reason, including violations of these Terms. Sections that by their nature should survive (including 6–9 and 13–19) survive termination.

13. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that video calls will connect, or that any user is who they claim to be, is of legal age, or will behave appropriately. We are not responsible for the conduct of any user, online or offline.

14. Limitation of liability

To the fullest extent permitted by law, Sunshine Wrap LLC, doing business as Bumped and its owners, members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to the Service, other users, or these Terms, even if advised of the possibility. Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Sunshine Wrap LLC, doing business as Bumped and its owners, members, managers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, your interactions with other users, or your violation of these Terms or any law.

16. Governing law

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. Subject to Section 17, any claim not subject to arbitration must be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.

17. Dispute resolution: arbitration and class-action waiver

• Try to resolve it first. Before filing any claim, you agree to email support@bumpedapp.com with a description of your dispute and give us 30 days to try to resolve it informally.
• Binding arbitration. If we cannot resolve it, you and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Miami-Dade County, Florida, or remotely by video or phone if the arbitrator allows. The Federal Arbitration Act governs this section.
• Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek court relief to stop infringement or misuse of intellectual property.
• No class actions. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not consolidate claims or award class-wide relief.
• Jury trial waiver. You and we waive any right to a jury trial.
• Opt-out. You may opt out of this arbitration agreement by emailing support@bumpedapp.com within 30 days after first accepting these Terms, with your name, account email, and a clear statement that you opt out.

18. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept them.

19. General

These Terms and our Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms; we may transfer them in connection with a merger, sale, or reorganization. Notices to you may be sent to your account email.
